New right of way in the pipeline
2010-04-13
The Ministry of Economic Affairs has prepared assumptions for the act which is to help in putting in order Poland’s regulations concerning land under transit lines (so called “right of way”), PAP reported.
In line with the bill’s assumptions, special corridors will be set up in which it will be possible to localise transmission installations. This should help investors who have to deal with land owners’ resistance when they want to modernise existing installations or build new transmission lines, including power lines, gas pipes, pipes carrying petrol and other fuels, sewage and water installations, as well as heating grids. Transit corridors will constitute legally separated out areas, with already existing or planned transmission installations. Investors executing public utility projects will be able to erect installations within the corridors. According to the bill, easements of transit – i.e. right of access to installations erected therein – will be established on the separated-out transit. As to date, property owners will be obliged not to do anything that would endanger the functioning of the installations found in the transit corridors, in return for the use of their properties they will receive compensation.
